b. You are responsible for maintaining the security of your account and password. We cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.

d. We reserve the right to refuse service to anyone for any reason at any time.

2. Products
a. We make every effort to accurately display our products, including colors and descriptions. However, we cannot guarantee that your device’s display of any color will be accurate.
b. We reserve the right to limit the sales of our products to any person, geographic region or jurisdiction.
c. Prices for our products are subject to change without notice.
d. Frametolia sells art from many sources and artists. Some of our art may be produced with the assistance of AI. If you are concerned, please contact us. 

3. Payment and Billing
a. We accept various forms of payment, including credit cards and PayPal.
b. By providing us with your payment information, you authorize us to charge the designated payment method for the total amount of your order.
c. We reserve the right to refuse any order you place with us. If we do so, we will attempt to notify you by contacting the email address or billing address provided.

4. Shipping
a. We offer shipping to the United States and Canada.
b. We are not responsible for any customs or import taxes that may be incurred on your order.
c. We will make every effort to deliver your order within the estimated delivery time, but we cannot guarantee delivery dates.

5. Returns and Refunds
a. We accept returns within 30 days of the purchase date. Returned items must be in their original condition and packaging.
b. We offer refunds for returned items, but we do not cover the cost of return shipping.
c. If you receive a defective or incorrect item, we will provide a replacement at no additional cost.

6. Intellectual Property
a. All content on our website, including but not limited to images, text, and logos, is our property and is protected by copyright and other intellectual property laws.
b. You may not use our content without our express written permission.

7. Termination
a. We reserve the right to terminate your account and access to our services at any time, for any reason, without notice.
b. If we terminate your account due to a violation of our terms of service, you will not be entitled to a refund for any unused services.

8. Disclaimer of Warranties
a. Our services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied.
b. We do not guarantee that our services will be uninterrupted, secure, or error-free.

9. Limitation of Liability
a. We will not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
b. In no event shall our total liability to you exceed the amount paid by you for our services.

10. Governing Law and Jurisdiction
a. These terms of service shall be governed by and construed in accordance with the laws of the United States.
b. Any dispute arising out of or relating to these terms of service shall be subject to the exclusive jurisdiction of the courts in the United States.

11. Custom Image Uploads
a. By uploading an image through our customization tool, you confirm that you own the rights to the image or have permission from the rights holder to use it for printing and framing. You grant us a limited, temporary license to use the image solely to produce and fulfill your order. We do not claim ownership of customer-uploaded images.
b. We reserve the right to refuse, cancel, or contact the customer regarding any order containing an image that is unlawful, infringing, or clearly unsuitable for printing at the selected size.

 

12. Custom Image Uploads Quality
a. Our customization tool may perform automated technical checks on uploaded images, including resolution, dimensions, and file size, to help identify files that may not be suitable for printing at the selected size. These automated checks are provided as a convenience only and do not evaluate image sharpness, focus, lighting, composition, or overall visual quality.
b. Passing an automated pre-qualification check does not guarantee print quality. The final printed result will reflect the inherent characteristics and limitations of the original image provided by the customer. Customers remain solely responsible for the visual quality of uploaded images.
c. We are not responsible for outcomes related to image quality, including but not limited to pixelation, blurriness, lack of sharpness, color shifts, or artifacts caused by enlargement, compression, or the original file. Colors may vary between screen and print due to device and display differences. Minor color variation does not constitute a defect.
